•••Deputy arrests a wanted subject while assisting Coos Bay Police with unrelated call for service••• On February 7th, 2024, at 7:27 p.m., Deputy H. Francis responded to the intersection of Lakeshore Drive and N. Morrison Street in Coos Bay to serve as a perimeter unit for the Coos Bay Police as they attempted a K9 criminal apprehension track of a suspect who stole a vehicle. While on perimeter and unrelated to the K9 track, Deputy Francis observed a subject with outstanding warrants walk by her location. Deputy Francis contacted Nicholaus D. Berger (45), and the Coos County Sheriff’s Office Dispatch Center advised he had several outstanding warrants for his arrest. The warrants were confirmed, and Mr. Berger was arrested and transported to the Coos County Jail, where he was booked and remains in custody.

Around 9:30 a.m. Monday, a 911 call was placed from a homeowner who lives on Olive Barber Road in Coos Bay advising she had observed live video footage from her surveillance system indicating a potential break-in at the home. Upon arrival, it was determined the home had been broken into and multiple items had been taken, including firearms. The sheriff’s office requested assistance in containing the scene by Oregon State Police and the Myrtle Point Police Department. A K9 search was initiated with the sheriff’s K9 Odin and deputies tracked the suspect about 300 yards from the residence. While tracking the suspect they located stolen property from the home and three firearms. K9 Odin and deputies located 40-year-old Nicholas D. Berger of Coos Bay concealed in the brush. Odin engaged Berger, ripping his jacket from him and, from within the jacket, a loaded 45 caliber handgun was located which had been taken from the residence, police said. Berger was arrested and transported to the Coos County Jail and lodged on the charges of first-degree burglary, first-degree theft and unlawful possession of a firearm.
